SPECIAL COUNCIL - ES ACTION (PUBLIC) - Potential Litigation

SPECIAL CITY COUNCIL MEETING A Special City Council Meeting was held on December 13, 2021 at 5:16 p.m. with Council President Sudler presiding. Members present were Mr. Anderson, Mr. Neil, Mr. Hare, Mrs. Arndt, Mr. Rocha, and Mr. Taylor (arrived at 5:17 p.m.). Mr. Boggerty was absent. Mayor Christiansen was also absent. Council staff members present were Mr. Hugg, Mr. Rodriguez, and Mrs. McDowell. Other staff members present were Mrs. Dietz and Mr. Osika. ADOPTION OF AGENDA Mrs. Arndt moved for adoption of the agenda, seconded by Mr. Neil and unanimously carried. Mr. Hare moved to recess into Executive Session pursuant to 29 Del. C. §10004(b)(4) - Strategy sessions, including those involving legal advice or opinion from an attorney-at-law, with respect to collective bargaining or pending or potential litigation, but only when an open meeting would have an adverse effect on the bargaining or litigation position of the public body. The motion was seconded by Mr. Rocha and unanimously carried. The Special Council Meeting recessed into Executive Session at 5:16 p.m. The Executive Session adjourned at 6:15 p.m. ACTION RESULTING FROM THE EXECUTIVE SESSION Potential Litigation During the executive session, members of Council considered potential litigation. Mr. Hare moved to refer the matter to the City Solicitor to retain someone to determine the cost and to make a recommendation for making all the employees whole. The motion was seconded by Mr. Taylor and unanimously carried. Mr. Rocha moved for adjournment, seconded by Mr. Hare and unanimously carried.
